By submitting this application, I agree to the collection, use and processing of the personal information I provide to the Executive Member Group (hereinafter referred to as “EMG”). The data collected will be used for business and administrative purposes that include but are not limited to processing my dues, assessing member qualifications, and other general uses at the discretion of EMG.

 

In order to ensure that my application is properly processed and managed, I agree to provide the correct business and personal information and to notify EMG of any changes to my business or my personal information.

 

I certify that the answers given herein are true and complete and I authorize investigation of all information contained in this application for membership purposes as may be necessary. I understand that any false or misleading information provided in this application or failure to adhere to Executive Member Group's Agreement, Release and Pledge shall be immediate grounds for denial or Executive Member Group termination.

 

As an applicant or member of EMG, I agree to abide by the principles contained in “An Executive Member Group Pledge” and any governing documents and policies. I will refrain from any form of illegal, unethical, or irresponsible behavior, including, but not limited to, harassment, defamation, fraud, and wavering integrity.

 

While EMG does not tolerate such unethical behavior by members I understand the risks associated with participating in a trade organization including, but not limited to, possible omissions, unintentional misrepresentation of my business, and possible unethical behavior by other members. If I engage in negligent conduct, harassment, fraud or defamation, I understand that I may be responsible to reimburse EMG, the Executive Member Group and other affiliates involved, the residual damages, losses, or costs associated with such conduct.

 

I understand the risks associated with participating in trade organizations including, but not limited to, possible omissions, misrepresentation of my business, and intentional or negligent acts on the part of the members.

I understand that the EMG Memberships are non-refundable.  No refunds will be issued if I am accepted into the program and all installments must be paid on a timely basis. 

 

I understand that Memberships are non-transferrable and any chargebacks will result immediate termination of my membership and a lifetime ban from membership in the future within the Executive Member Group and access to EMG affiliate events. 

 

I acknowledge that by submitting this application I am in no way guaranteed to be approved as an Executive Member, nor is it guaranteed that modifications will or will not be made to the annual executive membership fee; 

 

I waive all claims or other legal recourse against EMG or any of its respective agents, employees, representatives, affiliated entities, successors, heirs, and designees or legatees arising from or related to the application process, to the full extent allowed by law;

 

I understand and agree that any dispute or claim arising or related to this Agreement, its performance, breach, or interpretation (including issues about its validity or enforceability), shall be exclusively (except as provided below) resolved by final binding arbitration before the American Arbitration Association (AAA), utilizing its Commercial Arbitration Rules. One arbitrator shall be selected using AAA procedures. The arbitrator shall use all reasonable efforts to minimize discovery and to complete the arbitration proceedings as expeditiously as possible. The Arbitrator shall render a written decision within thirty (30) calendar days of the hearing.

 

The arbitrator will not award attorney’s fees, or punitive, incidental, consequential, treble or other multiple or exemplary damages, and the parties hereby agree to waive and not seek such damages. Either party may seek judicial relief to compel the other party to comply with the provisions of this Section, or injunctive or other equitable relief to protect its intellectual property rights, provided (unless prohibited by applicable law) that the remainder of the dispute or claim is submitted to arbitration. The arbitration shall be held in Los Angeles, California; both parties hereby give their irrevocable consent to jurisdiction of courts of or in the State of California, as well as processes of the AAA in California. Awards shall be final, binding and non-appealable (except on the minimal grounds required under the Federal Arbitration Act or other applicable law). All awards may be filed with one or more courts, state, federal or foreign having jurisdiction over the party against whom such award is rendered or its property, as a basis of judgment and of the issuance of execution for its collection;

 

I acknowledge and understand that this Agreement shall be deemed made in, governed by, performed in, and construed and enforced in accordance with the laws of the State of California, U.S.A., without giving effect to its conflicts of laws provisions or principles;

 

I represent and warrant that I have been advised of my right to seek legal counsel of my own choosing in connection with the negotiation and submission of this Agreement, Release and Pledge; I represent and agree that I have submitted this Application seeking membership in the Executive Member Group and signed this release of my own free will and without coercion, duress (either mentally or physically), or undue influence from EMG or any of EMG’s respective agents, employees, representatives, affiliated entities, successors, heirs, and designees or legatees;

 

I understand and agree that nothing in this application or release shall be construed to create a partnership or any other entity or business venture between EMG and me and/or my business enterprise/company or corporation;

I hereby apply for membership in the Executive Member Group and have read and understand the qualifications of membership, and payment requirements.

 

I agree to abide by the Executive Member Group Pledge, and to promote its objectives.
